The criminal record could be released online in the near future. The Minister for Digitization, Sebastian Bordoga, claims that the authorities are discussing a phased program.

Project: criminal record, wanted online, by Romanians abroad

A bill registered in the Senate states that, from next year, applications for a criminal record certificate can be submitted by Romanians abroad and by electronic means, directly to police stations in the country, and not just to diplomatic missions or consular offices from Romania, as in this time.

The proposed online application deadline is August 1, 2023

The draft reads: “Individuals abroad can request the issuance of a criminal record certificate by sending the electronic request to any police unit or sub-unit in Romania or by submitting the request to diplomatic missions or consular offices in Romania.” avocatnet.ro .

Release the criminal record of individuals – currently

In order to obtain a criminal record certificate from Romania, a natural person can submit the standard application in person, with complete civil data and motives, to any police sub-unit where there is a criminal record counter accompanied by an identity document (ID card, ID card, passport, temporary ID card and Certificate of Registration for EU Citizens, Residence Card, Permanent Residence Card, Temporary or Permanent Residence Permit, valid).

Persons residing abroad can request the issuance of a criminal record certificate through diplomatic missions or consular offices in Romania.

At the request of persons abroad, the diplomatic missions and consular offices of Romania may issue, after carrying out the necessary checks in the databases, certificates in which the results of the checks are recorded. These certificates have the legal value of a criminal record certificate and are used exclusively abroad.

The criminal record certificate of natural persons may also be requested by their agents, in accordance with the applicable legal procedures, as follows:

  • In the State, by a natural person’s attorney based on a power of attorney issued in accordance with the provisions of Law No. No. 51/1995 for the organization and work of the legal profession, republished, with subsequent amendments and supplements, and the statutes of the legal profession, approved by the decision of the Council of the National Federation of Romanian Trade Unions No. 64/2011, with subsequent amendments and completions, or, as the case may be, by another proxy, on the basis of a power of attorney certified by a notary;
  • Abroad, on the basis of a power of attorney certified by diplomatic missions or consular offices of Romania or by a notary, in accordance with the requirements for the legalization of foreign official documents. For countries that acceded to the Hague Convention on October 5, 1961, the application of an apostille is sufficient.

The content of the power of attorney, respectively, must be formulated in clear terms, which must result in the person or, as the case may be, the attorney who has been authorized, the purpose and duration of the power of attorney.

If the application is made by proxy, it will be accompanied by a copy of the identity document of the applicant, a copy of the identity document of the proxy and a power of attorney certified in accordance with the law.

Proxies issued in the Republic of Moldova or embassies of the Republic of Moldova, in Romanian, are accepted as valid without any over-certification.

When the criminal record certificate is required to be submitted to the individual pardon file, it may be requested by the convict, children, attorney, legal representative, spouse, ascendants, siblings or wife of the convict.

Where a criminal record certificate is required for the registry of operators within the community, the document must include in addition to the criminal penalties from the remaining final court decisions and provisionally specified data on the natural or legal persons against whom the criminal case was brought.

The certificate of criminal record is issued, as a rule, immediately, or within 3 days from the date of the application, in cases where the standard application is filed in Romania.

In cases where the application is submitted through diplomatic missions or consular offices of Romania, the certificate of criminal record is issued within 30 days from the date of submission, and in the case of certificates within 10 days from the date of the application.
