Simplification of the legal framework for support programs for the mountain region

At the government meeting on September 1, 2022, an emergency decree was adopted to amend some of the normative laws regulating support programs for the mountain region. In order to simplify and increase the predictability of the legislative process, three emergency decrees were combined into one Standard Act.

Thus, the legal framework that approves the investment program for the establishment of milk collection and/or processing centers in the mountainous region, the investment program for the establishment of mountain herds, and the investment program for the establishment of collection and primary processing centers. From fruits of modified forests, from mushrooms and/or medicinal and aromatic plants from saplings and/or cultivated in the mountainous region.

The programs will run until the end of 2022, and related payments can be made until December 29, 2023. The assistance is granted by the Ministry of Agriculture and Rural Development, and the authority responsible for managing the schemes is the National Mountain District Agency.

After the approval of this normative act, subsequent government decisions that will apply the provisions of the laws regulating support programs for the mountain region will be drawn up on the approval department. Thus, it will be possible to finance three investment programs for the sustainable development of the mountainous region, respectively:

The investment program for the establishment of milk collection and / or processing centers in the mountainous region, with the following types of investments:

– Investments in the establishment of respective milk collection centers to collect quantities of milk collected from producers and maintain them in optimal conditions: the capacity of milk cooling tanks is at least 1,500 liters, the maximum qualifying value is 500,000 lei.

– Investments in the establishment of dairy processing centers, respectively, for processing and preservation / storage in optimal conditions for products resulting from dairy processing. The maximum eligible amount – 1,700,000 lei;

Investments in the construction of milk collection and processing centers are, respectively, an integrated investment that includes both the collection component and the milk processing component. Eligible maximum value – 1,900,000 lei.

The investment program for establishing mountain herds:

Investments in the construction of mountain pens for processing milk and obtaining milk-derived products in appropriately arranged premises, animal shelters and animal breeders. The total eligible maximum value of the project is 300,000 lei.

The investment program for the establishment of mountain herds and the investment program for the establishment of centers for gathering and primary processing of forest fruits, mushrooms and/or medicinal and aromatic plants with the following types of investments:

– Investments in the establishment of centers for collecting forest fruits, mushrooms and/or medicinal and aromatic plants cultivated in the mountainous region, respectively for the collection, sorting, washing, conditioning and storage of forest fruits, mushrooms and/or cultivated medicinal and aromatic plants, with a maximum total project value of 600,000 lei .

– Investments in the establishment of centers for the collection and processing of forest fruits and / or mushrooms and / or medicinal and aromatic plants from saplings and / or cultivated in the mountainous region in the operations of collection, sorting, washing, processing, conditioning and storage in optimal conditions for forest fruits and / or mushrooms and / or Medicinal and aromatic plants are spontaneous and/or cultivar plants, with the project eligible maximum total value of 800,000 lei.

Beneficiaries of investment programs can be: authorized natural persons, sole proprietorships and family businesses, producer groups, agricultural cooperatives, legal persons, and legal persons carrying out activities in agriculture and/or the food industry.

Eligible beneficiaries, regardless of the type of investment they choose, must cumulatively fulfill the following conditions: carry out their activity in the mountainous region, have access to only one type of investment only once during the entire program period, and not receive similar support through the National Program for Human Development 2014-2020, including the transition period.
